Legal Information and Terms
1. TERMS AND CONDITIONS OF SALE
1. Purpose
These General Terms and Conditions of Sale govern the sale of artworks offered on the website leslielaporte.fr.
2. Artworks
The artworks offered are original works of art, described as accurately as possible (technique, dimensions, year).
Photographs are non-contractual but faithfully represent the artwork.
3. Prices
Prices are indicated in euros.
VAT not applicable, pursuant to Article 293B of the French General Tax Code.
Shipping costs are specified before order confirmation.
4. Orders
Any order implies acceptance of the prices and descriptions of the artworks available for sale.
I. CLAUSE - Deposit, Balance and Delivery - Commissioned / Custom Artworks
A. Project Selection and Feasibility Confirmation
The client defines the project:
desired format (according to the pricing scale)
style or reference model
dominant colors or specific elements
desired delivery date (subject to agreement with the artist)
The artist then confirms feasibility, price, and estimated timeframe.
B. Preliminary Sketch and Validation
The artist creates a preliminary sketch to visualize the overall composition.
The client may request one free revision (minor adjustments such as repositioning, detail refinement, atmosphere).
Major or extensive modifications may incur additional fees.
Once approved, the sketch serves as the definitive basis for the creation of the artwork
C. Quote Signature and Deposit Payment
A quote or written agreement is sent to the client.
A deposit corresponding to 50% of the total price is required upon validation of the sketch.
Payment of the deposit reserves the artist’s time, materials, and creation schedule.
Work on the artwork begins only after receipt of the deposit.
Non-refundable Deposit
In the event of cancellation of a custom order by the client, for any reason whatsoever, the deposit paid shall be retained by the artist and is non-refundable.
The deposit covers time already invested, the preparatory sketch, and material preparation.
If the artist is unable to complete the artwork for reasons beyond the client’s control (cancellation by the artist, force majeure, material shortage), the deposit will be fully refunded.
D. Réalisation de l’œuvre
The artist creates the artwork according to the validated sketch and agreed artistic direction.
Progress photos may be sent midway upon request.
Three minor revisions (small color adjustments, minor details) may be accepted free of charge.
Major changes (composition, proportions, addition of elements, etc.) after sketch approval will incur an additional fee of 10% of the artwork price.
E. Final Photos and Minor Adjustments
Once completed, the artist sends final photographs.
The client may request one final minor adjustment (light balance, contrast, small details).
Significant changes are no longer possible at this stage.
F. Payment of the Balance
The remaining balance must be paid before delivery or collection.
Shipment or handover will only occur after full payment is received.
Once the balance is paid, the artist will issue the final invoice and a certificate of authenticity.
G. Delivery or Collection
Studio collection: free of charge, by appointment.
Shipping: available within France and internationally, at the client’s expense.
5. Payment – Existing Original Artworks
Payment is due immediately upon order.
Accepted payment methods: [credit card, PayPal, bank transfer, etc.].
Payments are secure.
6. Delivery
Artworks are shipped to the address provided by the buyer within 7 business days after receipt of full payment.
Delivery is carried out via a carrier chosen in agreement with the buyer. Delivery times are indicative only. The artist cannot be held responsible for delays attributable to the carrier.
Artworks are carefully packaged. The packaging process is filmed. Shipping insurance may be included upon request depending on the value of the artwork and is at the buyer’s expense.
7. Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, the buyer has 14 days to exercise their right of withdrawal, except in the case of commissioned or personalized artworks (Article L221-28).
I. CLAUSE – Right of Withdrawal – Existing Original Artworks
In accordance with Articles L221-18 et seq. of the French Consumer Code, the buyer has a legal period of fourteen (14) days from receipt of the artwork to exercise the right of withdrawal, applicable only to existing original artworks offered for sale on the website.
Given the fragile, unique, and artistic nature of the artworks, this right is subject to the following strict conditions:
The artwork must be returned in strictly identical condition to that at delivery, with no signs of use, hanging, excessive handling, damage, or alteration.
The artwork must be returned in its original packaging or in packaging offering equivalent protection to ensure optimal transport safety.
Any damage, even minimal (scratch, mark, deformation, crease, impact, alteration of colors or support), will result in refusal of reimbursement.
Return shipping costs are entirely borne by the buyer.
The return is under the buyer’s sole responsibility, who must insure the artwork for its full purchase value.
Failure to comply with any of these conditions entitles the artist to refuse the return and reimbursement.
When accepted, reimbursement is issued after receipt and full inspection of the artwork.
II. CLAUSE – Commissioned / Custom Artworks
No Right of Withdrawal – Commissioned Works
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to commissioned or personalized artworks.
Commissioned or personalized artworks include any artwork created specifically at the buyer’s request, particularly when the buyer determines elements such as dimensions, colors, composition, theme, text, portrait, or any other specific characteristic.
Any order for a custom artwork is firm and final.
No return, exchange, or refund will be accepted once the order is validated, except in the case of a clear defect attributable to the artist.
9. Copyright and Intellectual Property
The artist retains full copyright in all artworks in accordance with the French Intellectual Property Code.
The purchase of an original artwork does not imply any transfer of intellectual property rights, including reproduction, representation, distribution, adaptation, exploitation, or broadcasting rights, on any medium whatsoever, whether known or unknown at this time.
The artist’s moral rights — including the right to integrity, attribution, and disclosure — are inalienable and perpetual.
The buyer acquires only the physical ownership of the artwork for strictly private use, excluding any commercial, public, or promotional use without prior written authorization from the artist.
Any reproduction, representation, distribution, or exploitation of the artwork, in whole or in part, without the artist’s written consent constitutes copyright infringement and may result in legal action.
10. Governing Law
These Terms and Conditions are governed by French law.
11. Privacy Policy
Personal data collected on this site is used solely for order management, customer relations, and, where applicable, the sending of information.
Collected data: name, surname, address, email, payment information.
Retention period: strictly necessary for processing purposes.
Data sharing: no data is sold or transferred to third parties.
In accordance with GDPR, you have the right to access, rectify, and delete your data.
